Criminal Courts (CERD Shadow Report, 2008)

Article 2 of the International Convention on the Elimination of All Forms of Racial Discrimination (“Convention”) requires the state party “to pursue by all appropriate means and without delay a policy of eliminating racial discrimination.” The Convention, in Article 2(c), also calls upon the government to “take effective measures to review governmental, national, and local policies” that have a racially discriminatory effect. More specifically, Article 5(a) of the Convention requires the state party “to prohibit and to eliminate racial discrimination in all its forms” and to ensure “[t]he right to equal treatment before the tribunals and all other organs administering justice.”
